S. Korean court upholds prison term for ex-president Park

South Korea’s Supreme Court on Thursday upheld a 20-year prison term for former President Park Geun-hye over bribery and other crimes as it ended a historic corruption case that marked a striking fall from grace for the country’s first female leader and conservative icon.
The ruling means Park, who was ousted from office and arrested in 2017, could potentially serve a combined 22 years behind bars, following a separate conviction for illegally meddling in her party’s candidate nominations ahead of parliamentary elections in 2016.
But the finalizing of her prison term also makes her eligible for a special presidential pardon, a looming possibility as the country’s deeply split electorate approaches the next presidential election in March 2022.
President Moon Jae-in, a liberal who won the presidential by-election following Park’s removal, has yet to directly address the possibility of freeing his predecessor. Moon has recently seen his approval ratings sink to new lows over economic problems, political scandals and rising coronavirus infections.
Many conservative politicians have called for Moon to release Park and another convicted former president, Lee Myung-bak, who’s serving a 17-year term over his own corruption charges. At least one prominent member of Moon’s Democratic Party, Lee Nak-yon, has endorsed the idea of pardoning the former presidents as a gesture for “national unity.”
Park, 68, has described herself a victim of political revenge. She has refused to attend her trials since October 2017 and didn’t attend Thursday’s ruling. Her lawyer didn’t return calls seeking comment.
The downfall of Park and Lee Myung-bak extended South Korea’s decades-long streak of presidencies ending badly, fueling criticism that the country places too much power that is easily abused and often goes unchecked into the hands of elected leaders. Nearly every former president, or their family members and aides, have been mired in scandals near the end of their terms or after they left office.

Arizona Supreme Court upholds election challenge dismissal

The high court ruling is the second time the majority-Republican court has turned aside an appeal of a court loss by backers of President Donald Trump seeking to overturn the results of the election. In all, eight lawsuits challenging Biden’s Arizona win have failed. It comes the day before a divided Congress is set to certify Biden’s victory.
Tuesday’s ruling from a four-judge panel of the high court agreed with a trial court judge in Pinal County that plaintiff Staci Burk lacked the right to contest the election. That’s because she wasn’t a registered voter at the time she filed her lawsuit, as required in state election contests. Both courts also agreed that she made her legal challenge too late, after the five-day period for filing such an action had passed.
Burk said in her lawsuit that she was a qualified Arizona voter, but officials said they discovered she wasn’t registered to vote. She later said she mistakenly thought “qualified electors” were people who were merely eligible to vote, and that her voter registration was canceled because election workers were unable to verify her address.
The Supreme Court said the fact that she wasn’t a registered voter was fatal to her ability to file an election challenge and that Burk admitted she knew she wasn’t registered.
“There is nothing before the Court to indicate that Appellant timely contacted the appropriate authorities to correct any problems with her voter registration,” Chief Justice Robert Brutinel wrote. “An election challenge ... is not the proper vehicle to reinstate voter registration.”
Biden won the state over Republican President Donald Trump by more than 10,000 votes and the results were certified last month.
The lawsuit brought by Burk, who isn’t a lawyer but represented herself, is nearly identical to a lawsuit dismissed in early December in federal court in Phoenix.
Burk’s lawsuit alleged Arizona’s election systems have security flaws that let election workers and foreign countries manipulate results. Opposing attorneys said the lawsuit used conspiracy theories to make allegations against a voting equipment vendor without any proof to back up claims of widespread election fraud in Arizona.
No evidence of voter or election fraud has emerged in Arizona. Despite that, Republicans who control the Legislature are pushing to review how Maricopa County, the state’s most populous, ran its election. Two subpoenas issued by the state Senate seeking an audit and to review voting machines, ballots and other materials are being challenged by Maricopa County.
Two of the failed legal challenges focused on the use of Sharpies to complete ballots were dismissed. Another lawsuit in which the Trump campaign sought inspection of ballots was dismissed after the campaign’s lawyer acknowledged the small number of ballots at issue wouldn’t have changed the outcome.
A judge dismissed a lawsuit in which the Arizona Republican Party tried to determine whether voting machines had been hacked.
Then a separate challenge by Arizona GOP Chairwoman Kelli Ward was tossed out by a judge who concluded the Republican leader failed to prove fraud and that the evidence presented at trial wouldn’t reverse Trump’s defeat. The state Supreme Court upheld that decision in an earlier ruling.
And a federal judge dismissed a lawsuit by conservative lawyer Sidney Powell, who alleged widespread election fraud through the manipulation of voting equipment. Burk’s lawsuit repeated some of Powell’s allegations word-for-word. |

China sentences lawyer who reported on outbreak to 4 years

A Chinese court on Monday sentenced a former lawyer who reported on the early stage of the coronavirus outbreak to four years in prison on charges of “picking fights and provoking trouble,” one of her lawyers said.
The Pudong New Area People’s Court in the financial hub of Shanghai gave the sentence to Zhang Zhan following accusations she spread false information, gave interviews to foreign media, disrupted public order and “maliciously manipulated” the outbreak.
Lawyer Zhang Keke confirmed the sentence but said it was “inconvenient” to provide details ? usually an indication that the court has issued a partial gag order. He said the court did not ask Zhang whether she would appeal, nor did she indicate whether she would.
Zhang, 37, traveled to Wuhan in February and posted on various social media platforms about the outbreak that is believed to have emerged in the central Chinese city late last year.
She was arrested in May amid tough nationwide measures aimed at curbing the outbreak and heavy censorship to deflect criticism of the government’s initial response. Zhang reportedly went on a prolonged hunger strike while in detention, prompting authorities to forcibly feed her, and is said to be in poor health.
China has been accused of covering up the initial outbreak and delaying the release of crucial information, allowing the virus to spread and contributing to the pandemic that has sickened more than 80 million people worldwide and killed almost 1.8 million. Beijing vigorously denies the accusations, saying it took swift action that bought time for the rest of the world to prepare.
China’s ruling Communist Party tightly controls the media and seeks to block dissemination of information it hasn’t approved for release. In the early days of the outbreak, authorities reprimanded several Wuhan doctors for “rumor-mongering” after they alerted friends on social media. The best known of the doctors, Li Wenliang, later succumbed to COVID-19. |

Senate confirms Barrett replacement on federal appeals court

The Senate has confirmed an Indiana prosecutor to replace Supreme Court Justice Amy Coney Barrett on a federal appeals court based in Chicago.
Thomas Kirsch, who currently serves as U.S. Attorney for the Northern District of Indiana, will replace Barrett as a judge on the U.S. Court of Appeals for the 7th Circuit. Kirsch was confirmed Tuesday on a 51-44 vote.
Three Democrats Arizona Sens. Kyrsten Sinema and Mark Kelly and West Virginia Sen. Joe Manchin voted for him in what was otherwise a party-line vote. Four Republican senators and Vice President-elect Kamala Harris did not vote.
President Donald Trump named Kirsch as Barrett’s replacement before she was confirmed to the high court in October, and the Senate Judiciary Committee advanced his nomination last week. Kirsch graduated from Indiana University and earned his law degree from Harvard.
Illinois Sen. Dick Durbin, who is expected to become the top Democrat on Judiciary in the next Congress, said Kirsch’s quick nomination and confirmation showed that Trump and Senate Republicans were intent on forcing through as many conservative judges as possible.
“They have kept the nominations assembly line going,″ Durbin said.
Sen. Todd Young, R-Ind., said Kirsch “is a man of character, he’s a man of integrity, and he believes in the rule of law.”
Sen. Mazie Hirono, D-Hawaii, said Kirsch’s nomination is “further entrenching the lack of diversity that is characteristic of President Trump’s judicial nominees,” noting that the appeals court he will join is the only all-white federal appeals court in the country.

Biden win over Trump in Nevada made official by court

The Nevada Supreme Court made Joe Biden’s win in the state official on Tuesday, approving the state’s final canvass of the Nov. 3 election.
The unanimous action by the seven nonpartisan justices sends to Democratic Gov. Steve Sisolak results that will deliver six electoral votes from the western U.S. battleground state to Biden.
The court action drew extra scrutiny amid legal efforts by the state GOP and Trump campaign to prevent sending vote-by-mail ballots to all 1.82 million active registered voters and then to stop the counting of the 1.4 million votes that were cast.
Nevada’s six Democratic presidential electors are scheduled to meet Dec. 14 in the state capital of Carson City.
Biden won Nevada by 33,596 votes, according to results approved by elected officials in Nevada’s 17 counties — including Clark County, which encompasses Las Vegas, and Washoe County, which includes Reno.
Biden got 50.06% of the vote and Trump 47.67%. Nevada Secretary of State Barbara Cegavske, a Republican who has avoided the public eye in recent weeks, presented the results to the court.
She noted the first-ever use of all-mail balloting statewide in a general election, same-day voter registration and early voting. “The result was more of a hybrid model where voters had a choice of how to participate,” she said, adding that a record number of voters participated.
Certification of the vote does not stop several lawsuits pending in state and federal courts.
They include bids by two Republican congressional candidates and a state Senate challenger to obtain re-votes in those races, an open-records case by the state GOP, and a U.S. District Court action alleging that thousands of ineligible people voted.
A federal judge in that case declined a bid for an immediate injunction that would have stopped the use of a signature verification scanner during the vote count.
Jesse Binnall, an attorney for the Trump campaign who is handling an election challenge pending before a state court judge, said Tuesday he intends to prove that so many fraudulent votes were cast statewide that Trump won Nevada.
Turnout among the state’s more than 1.8 million active registered voters was almost 77.3%, including mail, early voting and Election Day ballots cast amid the coronavirus pandemic, according to secretary of state data.
That was up from a turnout of 76.8% during the presidential election in 2016, when Democrat Hillary Clinton carried Nevada by a little under 2.5% over Trump. Nevada was one of several states due to certify the election on Tuesday. |
